Asked on 13/01/2014, Law & Labor Answer Experts answers Dr. Qaisar Metawea As per the Labor Law, the ESB calculation depends if you resign or your employment contract expires or your employer terminates your employment contract. If you resign, then Article (85) of the Labor Law applies and you shall be entitled to one third of the ESB award after a service of not less than two consecutive years and not more than five years, to two thirds if your service is in excess of five successive years but less than ten years and to the full award if your service is ten or more years. However, if your employer terminates your contract or your contact is expired, then Article (84) of the Labor Law applies and you shall be entitled to half-month salary for each of the first five years and a one month salary for each of the following years. The ESB award shall be calculated on the basis of the last salary and you shall be entitled to ESB award for the portions of the year in proportion to the time spent on the job.
