Cudia elevates case to Supreme Court by Ina Reformina, ABS-CBN News| Updated as of 03/14/2014 10:57 PM MANILA - Embattled Philippine Military Academy (PMA) Cadet 1st Class Aldrin Jeff P. Cudia has taken his case to the Supreme Court (SC), in an effort to block and nullify his dismissal. In his petition, dated March 10, 2014, Cudia urged the high court to issue a temporary restraining order (TRO) or status quo ante order (SQAO) to prevent the implementation of his dismissal. [I]t is respectfully prayed of the Honorable Court that upon the receipt of this petition a Status Quo Ante Order (SQAO) or a Temporary Restraining Order be issued... [f]or the PMA to cease and desist from approving the guilty verdict of the Honor Committee as the basis for separating or expelling Cadet Cudia from the academy, the petition read. Cudia urged the high court to order his inclusion in the PMA graduation rites on Sunday, direct the PMA to award him his academic honors, and commission him as a new Navy ensign. He also urged the high court to order the transmittal of his case records, and records of the proceedings of his case, to the PMAs Cadet and Review and Appeals Board (CRAB) for the PMAs CRAB to review all the records and evidence of the proceedings, including the video footage, even without new evidence. Cudia was dishonorably discharged from the PMA for violating its Honor Code, stemming from his tardiness in one class. His tardiness caused him to be meted with 11 demerits and 13 hours of touring; he appealed this punishment. However, the Honor Committee found him to have lied in his defense. Cudias petition with the SC landed with the Third Division. Up to now, two days before the PMA graduation on Sunday, Cudia has not secured a restraining order or injunction from the high court.
