Dear Hon Elected Representatives Why are we budgeting to Fight the Conch Farm while Taxes are being increased? As we deal with the debt and the need to balance the budget we need to ensure that we do not return to this position again. All in all we face an uncertain future with the Government of the TCI budgeting some three $3 Million Dollars and more to fight the Conch Farm’s Lawsuit. Hon Officials this does not make any sense and this madness must end because the TCI Government has no real reasons or grounds to fight this useless issue and a problem created by Governor Damian Ric Todd. Hon Ministers you should engage the Governor and the Hon Attorney General and seek reasons for this suit and whether it makes sense by any measure to expose our people to unneeded liability and the certain prospect that the Crown will lose the Lawsuit being necessarily brought by the Conch Farm’s TWI Industries. To begin with Former Governor, Damian Ric Todd has never forwarded any reasons in law or in the Development Agreement with the Conch Farm to try and take it upon himself to deny the Conch the Right to Fish Farm. In fact the Development Agreement with the Conch Farm and the Government provides for Fish Farming. The Governor was then in breach of that agreement to try and keep fish farming out of the Development Order with the Conch Farm. When the case is finally heard, because of this the Crown will lose, face over $100 million in damages and costs and try to pass the bill onto the TCI-Government. How will they pay? Increase our taxes more. Now without telling the people the Hon Ewing is spending some three million to fight this case, a case they should settle but at the same time trying to increase our taxes!! This is not sensible nor is it good policy and bad for the people. Members of Cabinet you need to present the following to the Governor and the Learned Attorney General in Cabinet because Rid Toad and Huw Shepheard are gone. 1. Why are we the TCI Government trying to fight the Conch Farm’s Lawsuit when it can only but increase the need for more taxes? 2. Why are we the Government still fighting for something that Premier Ewing and Minister Washington Misick both publicly stated that they do not support and want the Conch Farm’s case settled? 3. Has the Conch Farm Breached any law of the TCI. 4. Are not Conch Farming, Fish Farming, and green technologies consistent with TCI Law, the Environmental Charter, and the Constitution which mandates projects and sustainable development initiatives like the Conch Farm? 5. Why are we the TCI Government trying to kill a project which has provided jobs for over 29 years and plans to invest more to create more jobs? 6. Where the Development Agreement between the Conch Farm and the Government currently provides for Fish Farming, aren’t we the Government most certainly going to lose in Supreme Court or Arbitration and face the prospect of over $100 Million in costs and damages and more taxes? 7. Do you the Governor or the Hon Attorney General have any reports of any breaches committed by the Conch Farm in the 29 years it has been in the TCI? 8. Where there are no reports of any breaches why are you fighting the project and trying to stop It.? 9. It is because Governor Ric Todd was under instructions by the owners of Leeward? 10. Why are we the Government budgeting tree million for a lawsuit that we the Government cannot win, should not be fighting while at the same time trying to increase the taxes of the People of the TCI. Even after the Hon Premier filed a lawsuit stating that his Cabinet never met or considered any instruction to any AG to defend the Conch Farm’s Lawsuit against the Government.
