Dowry: A False creed where the victim is always a female Indeed, Dowry is not a mundane thing in our society. If one happens to go to any rural area of any Northern Indian states and lives there for 4-5 days, he would definitely learn that Dowry is the main reason of tussle in the families. However this context is not always true .In many cases, women are using this itinerary for nefarious actions against their counterparts. Now the things are likely to become better for the males who are or can be the victims of false allegations of dowry harassment on them, after the two recent judgements of the apex court related to the dowry provisions. Earlier under Section 304 B of the Indian Penal Code , when a woman die in circumstances other than normal within 7 years of marriage ,her husband or his relative should be deemed to have committed the dowry death if it was shown that the woman was subjected to cruelty or harassment by her husband or his relative. Now the Supreme Court has held that only persons related to the husband by blood, marriage or adoption can be prosecuted for dowry death offences. Another feather in the cap is the removal of the provision of the automatic arrest after the institution of the case. The police have now to issue notice of appearance to the accused in terms of Section 41A of the Criminal Pc. Within two weeks from the date of the institution of the case. The Magistrate while authorising detention of the accused shall peruse the report furnished by the police officer and only after his satisfaction, the Magistrate will authorise detention. With the above two changes in law, we can hope of a situation where the males are not bolstered in the feminist movements and this too when the percentage of males sentenced for the dowry is less than 30% of the total cases registered.
