Facially, the ballot initiatives put forward by Jared Polis - despite good intentions (or appearance of good intentions) to regulate an unregulated private industry - are an attempt to constitutionally qualify an unqualified for profit private industry. Why would any of us vote to give constitutional standing to an unregulated private interest (COGA) that was given eminent domain authority through legislative overreach under unconstitutional statute (COGCC)? In essence, We the People of Colorado are being asked through the ballot initiatives to support amending our constitution to justify an unjustified entity.
