To Hon’ble Rahul Gandhi General Secretary, Congress (i) 10 Janpath, New Delhi Sub.:- Real situation of Congress (i) Party at ground level in Haryana Respected Sir, Circumstances forced me to intimate you about the real situation of Congress (i) Party at ground level in Haryana. I submit few lines for your kind consideration and appropriate action. Congress Party wins the 67 seats in General Election of Vidhan Sabha in 2005. The situation of Govt. Schools was that there were 57 Schools such in which a single student could not pass in Haryana School Board Education Exam. Of Middle Class (Dainik Bhaskar dated 10-5-2005 Page-3) Directorate of Secondary Education Haryana invited the application for various posts of Teachers on contractual basis up to the period of 31-3-2006 vide Advt. No. 1/2005 (Punjab Kesari dated 07-7-2005) to meet the shortage of teachers in Govt. Schools and responsibility given to Punjab University Chandigarh to prepare the merit list of meritorious candidates and selection process was over for Advt. No. 1/2005 within 40 days (The times of India dated 13-7-2005 Page-4). Teachers on contractual basis could be joined on 16-8-2005, but Education Department of Haryana did not do so. Firstly, Education Department extended the last date for submission of the application (The times of India dated 24-7-2005 Page-4) later on asked the affidavit from those candidates who passed the metric class from village school (The tribune dated 05-10-2005 Page-13)The Hon’ble former Education Minister gave a statement that the teachers on contractual basis will be join on 01-11-2005 (Dainik Bhaskar dated 11-10-2005 Page-3) but Education department Haryana did not issue the joining letter to any candidate from the merit list prepared by Punjab University Chandigarh vide Advt. No. 1/2005 and Govt. Schools run without the teachers and students were waiting for teachers since March 2005 to the end of the year, whereas list of selected candidates of teachers on contractual basis against Advt. No. 1/2005 was with the Education Department of Haryana. In October 2005 Education department change the policy stating that within one week application will be inviting for regular recruitment of Teachers (Dainik Bhaskar dated 23-10-2005 Page-1) but Education Department did not do so and appointed the Guest Faculty Teachers vide Endst. No. 15/59-2005 C.O. (3) dated 29-11-2005 without any advertisement and without the provision of reservation as per Haryana Govt. Policy. It is clear written in this letter that however the centralized advertisement will be issued from the Directorate indicating the board terms of engagement, but did not publish the advertisement. Question is that when list of selected candidates of teachers against their Advt. No. 1/2005 for contractual basis prepared by Punjab University Chandigarh was available with Education Department why they issued the letter dated 29-11-2005 which violates the Fundamental Right and reservation policy of Haryana govt. Why did not appoint the Guest Teacher from the said list. I sought this question under RTI Act 2005 and approached to the State Information Commission Haryana vide case no 3033/2010, but could not get the information till date. Haryana staff section commission invited the application vide Advt. No. 6/2006 for the recruitment of teachers & lecturers in July 2005 whereas as per statement of Education Department these posts must be published in first week of November 2005 (Dainik Bhaskar dated 23-10-2005 Page-1) The Education Department not only delay in inviting application for recruitment of teachers & lecturer but also made the provision of 50% reservation of those candidates who pass the metric from village school (The Tribune dated 20-7-2006 ) which was unconstitutional and it was challenged in the Hon’ble Punjab & Haryana High Court, Chandigarh. Due to this, selection process delayed for 3 years. On other side Guest Faculty Teachers continue by violating the Fundamental Right & reservation policy of Haryana Govt. I wrote a request dated 16-2-2007 to Director, school education Haryana for reservation in Guest Faculty Teacher, but education department did not take action on my request. In March 2007 Dr. Sita Ram an MLA of INLD asked the question in Haryana Vidhan Sabha about Guest Faculty Teachers & the Hon’ble Education Minister inform the House about the same according to him 70% General and only 8% SC candidates appointed as Guest Teacher. A single candidate from Ex-serviceman category did not appointed as a Guest teacher (Dainik Jagaran dated 13-3-2007 Page-5) whereas as per Judgment of Hon’ble Supreme Court of India dated 25-3-1996 in Civil Appeal No 6887/1996 with Civil Appeal No. 6888-90/1996 the object of reservation of the Ex-serviceman is to rehabilitate them after their discharge from the defence services. After Kargil War, Haryana Govt. enhanced the horizontal quota of reservation for ESM from 10 % to 15 % vide C.S. Hr. No.22/19/99-3G.S. III dated 14-7-2000, but Education Department neither implement the Judgment of Hon’ble Supreme Court of India dated 25-3-1996 nor consider the reservation policy of Haryana Govt. dated 14-7-2000. I wrote a request dated 28-3-2007 to Hon’ble Education minister Haryana for reservation of ESM in Guest Faculty Teacher and its copy sent to Director, school education Haryana, but neither the office of Education Minister nor Education Department taken action on my request. I continue writing request to Education Department and Haryana Govt. vide letter dated 11-8-2007, 28-11-2007,23-1-2008, 12-3-2008 & 07-2-2009 but none of these Authority took action on my said request. I sought the information dated 21-4-2010 under RTI Act 2005 on my these requests and approached to State Information Commission Haryana vide case no. 2947/2010 but could not get the information, than I wrote a complaint to Central Information Commission but CIC sent my complaint to SIC Haryana vide letter no.130355/21.6.2011 dated 15-2-2012 and till now I am empty hand. As per RTI report of Punjab University Chandigarh letter no 2553/R/375 total 158822 candidates applied against Advt. No. 1/2005 and Rs.63 Lac paid to Punjab University Chandigarh for this. I sought information dated 26-10-2010 under RTI Act 2005 about same from the o/o Director, School Education Haryana but Education Department neither supplied the information nor rejected RTI Application as per provision U/S 8 & 9 of RTI Act 2005. I approached to the SIC Haryana vide my Second Appeal dated 24-9-2011 but Commission neither issued the notice nor rejected my second appeal. I sent the reminder dated 05-12-2011 & 08-2-2012 but no response received from SIC Haryana. I sought the help from Zee helpline (Zee News) vide my request dated 25–1-2012 but Zee Helpline also refuse me to help in this matter, so lastly I knocked the door of Hon’ble Punjab & Haryana High Court, Chandigarh and Hon’ble High Court issued the notice to State Information Commission Haryana vide CWP No. 6768/2012. Haryana Govt. amended the rules 1994 & 1998 on 24-7-2008 and made the STET Compulsory for regular recruitment of teachers/lecturer and the Guest Faculty Teachers dragged Haryana Govt. in the Hon’ble High Court, then also Haryana Govt. made the provision for exemption of STET & 24 marks for experience only for Guest Faculty Teachers in Advt. No. 3/2009 of HPSC & Advt. No. 4/2009 of HSSC which was unconstitutional and I was forced to knock the door of Hon’ble High Court vide CWP No. 16234/2009 & 19464/2009 and process of recruitment Teachers/lecturers delayed. Judgment is with CWP No. 13045/2009. Due to this discrimination the Congress Party lost approximately 30 seats in 2009 General Election which we (People of Haryana) intimated you vide our letter dated 23-1-2010 which was signed by 373 candidates and 17 Question raised by the common people of Haryana including announcement of Hon’ble C.M. of Haryana in June 2009 for the formation of separate Board for the recruitment of teachers and why Haryana Govt. did not adopting the system of Kendriya Vidhalya so that process of recruitment of teachers can be completed before the retirement of teachers. Copy of this letter sent to Hon’ble C.M. and Hon’ble C.M. gave the statement within one week that Haryana Govt. will fill up 28000 posts of teachers without any hurdle and such system will be adopted so that the process of recruitment of teachers will be over before the teacher retire (Amar Uzala dated 28-1-2010 Page-3) but did not do so till. Education department neither rehabilitate me as per Judgment of Hon’ble Supreme Court of India dated 25-3-1996 nor considered the reservation policy of Haryana Govt. dated 14-7-2000 and also not gave the equal opportunity in Guest Faculty Teachers as per Article 16 of Indian Constitution not only this the Education Department also violated the Fundamental Right i.e. Article 14 of Indian Constitution by appointing the Guest Teacher from the same village where post was vacant by discriminating the candidate of neighbouring village. Under RTI Act 2005 I could not get the information in case no 2947/2010 & 3033/2010 and Education Department neglected my RTI Application dated 26-10-2010, so I wrote a request dated 25-2-2011 to Hon’ble President of India for permission to burn my original degree in the presence of media and its copy sent to Hon’ble President of Congress (i) Smt. Sonia Gandhi and also a copy to Hon’ble C.M. of Haryana, then the commissioner of education department Smt. Surina Rajan submitted an affidavit on 24-3-2011 in Hon’ble High Court in connection with CWP No. 6090/2010 stating that Haryana Govt. will give the approval on 07-4-2011 for conducting the STET Exam. Sale of prospects for STET will be start on 15-4-2011 and examination will be conducted by Bhiwani Board in the June end. Process of regular recruitment of teachers will be over up to 31-12-2011 and teachers will be appointed on all vacant post in Govt. Schools up to 01-4-2012, by considering this affidavit Hon’ble High Court gave the decision on 30-3-2011 that while it will be open to the State to extend the tenure of the Guest Teachers, at all levels, such extensions shall not be beyond 31-3-2012. In fact on the expiry of said date i.e. 31-3-2012, the service of all the Guest Teachers shall be understood to have lapsed in terms of the present order and it will not be open for State to continue any such Guest Teachers in service, but education department did not follow the schedule placed on 24-3-2011. After 4 months this news published in Punjab Kesari dated 20-7-2011 Page-3 with the version of Secretary of Bhiwani Board and within one week on 27-7-2011 Board issue the schedule for STET & start the sale of prospects w.e.f. 02-8-2011. Examination date was 24 & 25 September 2011 but Haryana Govt. postponed it for 5 & 6 November 2011. Mean while increase the 20 % payment for Guest Teachers forth times in September 2011 whereas meritorious candidates are bound to work at very love payment in private schools it gave the negative effect on the common people of Haryana and people of Haryana taught the lesson to Congress Party in Hisar by-election. Women Sainik not working in all the three Armed Forces then also Haryana Govt. made the provision of 33 % reservation for female in ESM category. Women in defence are working as officer only and their strength is negligible. Haryana Staff Selection commission selected the DESM on the post reserve for ESM (Female) in 2009 & 2010 against Advt. No. 6/2006 stating that not availability of ESM (Female) candidates, whereas as per Judgment of Hon’ble Supreme of India dated 25-3-1996 in Civil Appeal no 6887/1996 with 6888-90/1996, the object of reservation of the Ex-serviceman is to rehabilitate them after their discharge from the defence services. Moreover the policy of Haryana Govt. for reservation of children of ESM Hr. No. 12/8/03-4GS II dated 06-6-2003 also prescribes preference of ESM over DESM, then also education department give the joining of DESM on post reserve for ESM (female). When HSSC selected 24 DESM on the post of PTI which were reserve for ESM (male/female) and result published in April 2010, ESM Sh. Krishan Kumar and others knocked the door of Hon’ble High Court vide CWP No. 7067/2010 (The Tribune dated 27-4-2010 Page-4). After that other effected ESM also knocked the door of Hon’ble High Court and now 19 writes are connected with CWP No. 7067/2010. Haryana Govt. amended the Rules 1994 vide E.D. Haryana Notification No. GSR -20/Const./Art.309/2008 dated 28-7-08 pub. In Hr. Gaz. Dated 24-7-2008 and following entries substituted in the Haryana Primary Education (Group-C) District Cadre Service Rules 1994 in Appendix-B, namely:- (i) Metric with Hindi/Sanskrit. (ii) Certificate of having qualified School Teacher’s Eligibility Test (STET). Education Department did not send the requisition as per Rules 1994 & amendment in 2008 for the post of JBT Teacher. That’s why 411 posts remain vacant in Advt. No. 4/2009 of Haryana Staff Selection Commission result published in September 2010. I wrote a request dated 20-9-2010 to Secretary of HSSC to consider my request as per Rules 1994, Hr. Notification No. GSR-77/const./Art. 309/94 dated 16-9-1994 and a reminder dated 30-11-2010, but HSSC did not consider my request and I knocked the door of Hon’ble High Court vide CWP No. 6337/2011 and Hon’ble Court directed the HSSC on 08-4-2011 to decide the petitioner request dated 20-9-2010 & 30-11-2010 as per Rules within a period of one month but HSSC disposed of the Hon’ble High Court order dated 08 April 2011 without going through the Rules 1994. I again wrote a request dated 26 May 2011 and requested please refer Haryana Primary Education (Group-C) District Cadre Service Rules 1994, as per appendix-B of this Rule, Academic Qualification for direct recruitment of JBT Teachers, it is clear written in Note II in case of non availability of JBT Teachers the candidate having higher qualification such as B.A. or B.Sc. B.Ed. may be considered for the posts of JBT Teachers. I submitted this request personally at HSSC, but no response received. I sought information dated 11-7-2011 under RTI Act 2005 about this request and first appeal dated 16 Aug 2011, but no response received. Lastly I knocked the door of Hon’ble High Court vide CWP No. 20159/2011. New regular selected teachers posted to remote area so that Guest teachers remain in service not only that some regular teachers attached to BEO office’s and paid Rs. 56 Lac as payment without work (Punjab Kesari dated 17-10-2011 Page-3). Advt. No. 4/2009 for the post of S.S. Master Selection process completed in May 2011 but till date final result did not published by HSSC whereas there is acute shortage of teachers in Govt. Schools (Dainik Bhaskar dated 12-1-2012 Page-3). STET qualified candidates gave the proposal that they will teach free in Govt. Schools till the appointment of regular teachers and requested implement the Hon’ble High Court Decision dated 30-3-2011 passed in CWP No. 6090/2010 (Punjab Kesari dated 27-2-2012 Page-3) but Education Department neither follow the schedule which was submitted by the commissioner of education department on 24-3-2011 nor accepted the proposal of STET qualified candidates. Situation of Govt. School is miserable. As per RTI report neither the children of Govt. Teachers nor the children of Guest Teachers are studying in Govt. Schools. Expenditure on education is 16 % of the Budget which is paid by common people of Haryana in the form of direct or indirect tax and on other side common people is forced to admit their ward in private schools because of shortage of teachers the standard of education is very low in Govt. Schools. Likewise Govt. of Haryana cutting both the pockets of common people by both the hands. Haryana Govt. observe the year 2008 as Education Year, but result of that year of first semester examination of Board Classes was below 30 % (The Tribune dated 10-2-2009). Haryana Govt. change the policy and increase the pass % in final result by passing such students who score less than 5 marks in written examination by adding the 30 marks of internal assessment supplied by schools. As per RTI Report letter no. WSPIO/1213 dated 03-3-2010, there were 288030 students who score between 10 to 15 marks, who score 5 to 10 marks were 129369 and who score less than 5 marks were 9276 in written examination. Total 426675 (288030+129369+9276) students who scored less than 15 marks in written examination were passed in final result by adding 30 marks of internal assessment (Punjab Kesari dated 08-3-2010 Page -7). As per report of ASIR a student of 5th class is not able to read the books of 3rd class in Govt. Schools of Haryana (Punjab Kesari dated 02-5-2011 Page-5) As per RTI Report the process of passing the failure students by giving the grace marks 30 to 40 is still continue (Dainik Jagaran dated 17-12-2011 Page-3). There is acute shortage of teachers in Govt. Schools (Dainik Bhaskar dated 12-1-2012 Page-3). Hon’ble Education Minister also accepted in Vidhan Sabha that 40 % sanctioned posts of teachers are lying vacant in Govt. Schools (Dainik Bhaskar dated 04-3-2012 Page-4) and 3000 teachers retired on 31-3-2012 ( Amar Uzala dated 03-4-2012 Page-10). In this situation how we aspect that common people of Haryana will cast the vote in favour of Congress (i) Party in 2014 General Election. Haryana Govt. amend the Rules on 24-7-2008 and make the STET compulsory for recruitment of Teachers/Lecturers and conducted the STET four times, total expenditure of candidates is Rs. 70 Crore and more than one Lac candidates passed the STET, but after the decision of Hon’ble High Court dated 30-3-2011 Haryana Govt. did not recruited the teachers in Govt. Schools. The STET qualified candidates gave the proposal that they will teach free till the recruitment of regular teachers ((Punjab Kesari dated 27-2-2012 Page-3) but Education department did not accepted their proposal. If Haryana Govt. followed the Judgment of Hon’ble High Court dated 30-3-2011 regular recruitment of teachers could be completed before the Hisar by-election. Haryana Public Service Commission did not publish the screening result of Advt. No. 3/2009 for the posts of Lecturers (School Cadre) as per Rules and it was challenged by female candidate vide CWP No. 767/2011 and another candidate of BC category vide CWP No. 3280 of 2011 and recruitment delayed. In final result of Hindi Lecturer Roll No. 5331 & 8392 selected in ESM category whereas both were unqualified in General-Female category at Sr. no. 911 &1804 respectively and Roll no. 2367 & 3391 also selected as DESM whereas 17 ESM screening qualified candidates were available. Total 7 posts were reserve for PH of Haryana, 5 for male & 2 for female. 15 male & 7 female passed the screening test but in final neither male nor female selected. In Political Science also Roll No. 1822 selected in final result in ESM category whereas he was unqualified in same category at Sr. no 6 and 4 posts kept vacant whereas 16 ESM were available in screening qualified list. Total 6 posts were reserve for PH of Haryana, 4 for male & 2 for female. 13 male & 5 female passed the screening test but in final neither male nor female selected. Haryana Public Service Commission sent the objection letter to me and I replied with proof on 15-3-2012 which is received by HPSC on 16-3-2012 and I sent a reminder on 29-3-2012 which is received by HPSC on 02-4-2012, but HPSC neither considered my request dated 15-3-2012 nor rejected, so I wrote a request to Hon’ble Chief Minister Haryana on 14-4-2012 which is received by the office of CM on 20-4-2012. Now HPSC sent the rejection letter stating that you do not possess Master Degree in relevant field with at least 50 % marks on or before closing date 31-5-2010 which I received on 16-4-2012, whereas I passed the M.A. History in 1999 from University of Pune and relevant subject is M.A. History. I score 450 marks out of 800 in M.A. History. There were total 8 papers and each paper was of total 100 marks. It is printed on my marks sheet. Beside that higher second division (55 % to 59 %) is clearly written on my marks sheet of M.A. History. Further I state that Syllabus for M.A. History of Pune University also available on internet, which I studied for M.A. History and name of all 8 papers printed on my marks sheet. HPSC published the result of screening test of Lecturer in History on 24-12-2010, including me only 9 ESM passed in this test and 9 posts were reserved for ESM. HPSC is again trying to select the DESM instead of ESM (Me). Now circumstances are forcing me either I should burn my all original Degrees in the presence of Media without the permission of Hon’ble President of India or knock the door of Hon’ble Supreme Court of India as per PIL Guidelines and Article 32 of Indian Constitution. In view of the above facts I therefore request you take necessary action so that we can claim in 2014 General Election. If Haryana Govt. desires the process of recruitment of regular Teachers/Lecturers can be completed within two months as Punjab University Chandigarh completed the selection process of teachers for the Advt.
