From: Michael Grudecki Sent: Friday, October 4, 2013 3:32 PM To: Bajor, Jason; McGrath, Bill Subject: Tini Lounge - Batavia Jason and Bill- I am sending this email for two main reasons. The first is to provide feedback to the both of you regarding my experience in doing business with the City of Batavia, specifically with you’re department and the second is to copy the Batavia City Council so they can see what Batavia will no longer be an option for businesses I invest in due to my poor experience. This process started almost 2 years ago with Meredith Hannah and Joi Cuatero approaching me about moving my furniture business to the downtown area. While not the right fit because of the physical requirements my business has, I did offer up another concept that I believed based on my 15 years of corporate marketing background would add benefit and diversity. After multiple meetings, more than one of which Jason Bajor never showed up for although committing to attending, we came to a line in the sand. I was not willing to rent for my business concept and Jason Bajor stated he was unwilling to support my concept and noted that his department would not either although contrary to feedback received prior to his statement. It was at that point in the summer of 2012, almost 6 months after submitting my initial business plan that I requested the opportunity to go before Batavia’s City Council. An RFP was developed during the time that I pressed to go in front of City Council and submit my plan accordingly. Fast forward to the day before the City Council meeting, I visit the City of Batavia’s website to not only find my complete business plan published, but also my Home Address, Personal Social Security Number, Business Address, and Business Tax ID Number. Just this carelessness alone from your department should have resulted in severe disciplinary actions up to and including termination. After multiple attempts and days to remedy this problem which included Google, Yahoo, and other search engines republishing this confidential and private information, my Partner was able to provide the City’s IT Person with instructions on how to remove this data from search engines. How is this possible? This of course was after but my Attorney and I were already told it was down and must just be my computer which later turned out to be inaccurate offering my information to the billions of daily internet users. Continuing my presentation that night, while upset and distracted, I presented my plan to the city even though my confidence was all but lost. Fast forward to the chain of emails below as a sample of my continuing to reach out to Jason. Most of the time, information was only provided when asked and never felt kept in the loop, let alone welcomed to continue with my concept with the City of Batavia, specifically Jason Bajor. Fast forward to a telephone call today. During a presentation with a client, an individual stating he was a consultant for the City called me (on what I believe to be speaker phone due to the echo) and went into a rather lengthy explanation as to why the city would be pursuing a 3rd parties plan. Caught off guard thinking that another City Council meeting would occur, I asked when this other plan would go in front of City Council at which time I was told it might not. I informed the caller that had me on the phone that I was not interested in doing business with the city any longer with regards to the Tini Lounge and did not feel it was necessary to offer further contact information. After all, my contact information was provided per the requirements of the RFP, published on the City’s website, and should be in a file. Receiving a call from someone I have never spoke to is not only disappointing after just under 2 years of dialog, but also different then my take base on the last communication via email provided below. Throughout this whole process, I feel information has been provided scattered at best. Based on my experience up to now, I am not sure that Batavia was ever the right community for Tini Lounge or any new small business owner and I am questioning if it is worth investing anyone money in building Vignette’s brand as a small business in Batavia. I am not only disappointed that Tini Lounge will not open in Batavia and bring new interest, but also in the process that I feel was unprofessional! Thank you for your time. Regards,
