If you have inherited a property in Spain, you have probably paid much more inheritance tax than you should have. In fact, you shouldn’t have had to pay almost anything. The Spanish Government has fixed and Inheritance Tax with no exemptions for non-residents, when in most cases, Spanish nationals have tax exemptions of up to around 95%, depending on where the property is located. The good news is that the European Court of Justice has declared that Spain has not complied with its obligations regarding the Treaty of the Functioning of the European Union and the European Economic Space Agreement by treating residents and non-residents differently.
