ICCC approves Telikom acquisition of Datec Ltd Source: PNG Loop, 30/08/13 he Independent Consumer and Competition Commission (ICCC) have completed an assessment of the proposal by Telikom (PNG) Limited to acquire Datec (PNG) Limited from Steamships Trading Company. Chief Executive Officer, Dr Billy Manoka, said: “The areas of competition likely to be affected by this proposed acquisition are in: (1) the provision of wholesale bandwidth services to ISPs; and (2) the retailing of broadband internet access services or ISP to end-users.” The ICCC Act prohibits business acquisitions that would have, or would be likely to have, the effect of substantially lessening competition in a market, unless such arrangements are cleared by the ICCC. The effect of the ICCC grant of clearance is an exemption of the proposed acquisition from such prohibition. It concludes that in the areas of competition concerns the proposed acquisition will not have, and will not be likely to have, the effect of substantially lessening competition. Accordingly, the ICCC gives Clearance for the proposed acquisition to proceed. In giving the clearance, the Commissioner advised “Clearance only applies to proposed acquisitions and as such if Telikom and Steamships have concluded the transaction before this decision is handed down, the parties would not be protected under the ICCC Act. Hence the acquisition could be challenged.
