Impersonating a police officer or any other law enforcement officer/personnel in the State of Florida is a third degree felony punishable by up to 5 years in prison. If the person impersonates an officer during the commission of a felony offense then the charge is enhanced to a second degree felony, punishable by up to 15 years in prison. Pursuant to Fla. State 843.08, to prove this crime, the state must prove the following two elements beyond and to the exclusion of all reasonable doubt: 1. Falsely assumes or pretends to be a law enforcement officer and 2. takes it upon himself or herself to act as a law enforcement officer. sun-sentinel/news/crime/fl-tamarac-fake-police-officer-20141226-story.html
