May It Please Your Lordships: 1) I, Ms.Roshani S.Bafna age,53, most respectfully beg to restore the cr.w.p. no.2037/2014 and be pleased to review the order dt. 10.6.2014 passed by Your Lordships. The copy of said order is herein annexed at Exh.A for Your Lordships kind perusal. 2) It is most respectfully submitted that on 10.6.2014 when the said matter was called out, I wanted to read the facts from the affidavit dt.30.5.2014 filed by me in said matter,but the advocate for respondents have misleaded Your Lordships and hence Your Lordships have dispossed off the said matter without hearing to me. In view of this miscarriage of justice and justice is denied to me ,by letter dt.19.6.2014,to Honble CJ. I brought these facts to his kind notice. I crave leave to produce the copy of said letter when required. 3) In view of it,on 26.6.2014 Yopur Lordships were kind enough to hear me. As Your Lordships were satiesfied in terms of prayer 2, I was directed to get the matter circulated. Hence on 27.6.2014 Your Lordships were kind enough to grant me circulation for 10.7.2014. and directed me to give notice to other side. Hence by reg.post dt.1.7.2014 I sent notices to all respondents.I crave leave to show it when required. 4) On 10.7.2014, the matter was not shown on board ,hence Your Lordships were kind enough to allow production of papers. When the matter was called out, Your Lordships directed me to file an application for restoration of said Cr.W.P.No.2037/2014. 5) In view of these direction present restoration application is filed to be reviewed the order dt. 10.6.2014 passed by Your Lordships. 6) I am pained to say that without my any fault, I became the victim of cruelty for dowry since the day of my marriage at the hands of my ex-husband,& greedy in-laws (Order & Judgment dt.21.8.1992 in 37/1992), cheated by Respondents hereinabove in the matter of land given by my late mother , cheated by Broker Motilal Oswal & his sub-broker Jaykumar Bafna for Rs. 15 lakh, cheated by builder Ramniklal & Natwarlal Shah at Dahanu ,for Rs. 12 lakh 90 thousand , all known person and family friends have grabbed my all amount kept by my late mother for me & my alimoney amount received to me at the time of Divorce, and the Court at Dahanu has decided the matter without hearing me,carried proceedural injustice on me and till today made me to run from pillar to post. Thus I lost valuable period of my life of 28 years in getting justice and suffered from tuberculosis,thyroid,vertigo,lost my all teeth and many ailments apart from loosing my all wealth given to me by my late mother for my survival. But the respondents by their corrupt practices have made the false,forged and fabricated revenue record of my land & obtained the illegal order by fraud within 4 months from the court at Dahanu which gives me feeling of not only denial of justice but compelling me to think to end the life. Prayers : 1) Be pleased to restore the Cr.W.P.No.2037 / 2014 & kindly review the order dt.10.6.2014 passed by Your Lordeships. 2) Any other relief may be granted which is in the interest of justice. I shall be gratefully obliged for this act of kindness.
