However, to further our position, we have contacted the school and encouraged them to implement the contract and waived our right to file any kind of unfair labor practice against them for doing so. Answer: That is a position that the employer may take, but it isn’t practical in reality. The status quo must be maintained while the parties negotiate. That is why it is important that the employer implement the new agreement. That represents the new status quo. If an agreement isn’t reached, the status quo must be maintained until impasse is reached. So why would we start from scratch when the status quo is better than that. It is not reality. The relief houseparents are impacted by the contract, pay dues, and under the law should be entitled to vote. Even local 464 told them so in a letter dated May 20th, 2013. Answer: The parties reach an election agreement before the National Labor Relations Board held the hearing. The election will be held in Founder’s Hall on two separate days. October 4th and October 11th, will both be days that voting occurs. On October 4th, the polls will be open from 8:30 Am to 11:30 Am, and then again from 4 Pm to 6 Pm. On October 11th, the polls will be open from 4 Pm to 6 Pm. Please exercise your right to vote. All full time houseparents, flex houseparents, relief houseparents, emergency relief houseparents, transitional living assistants, and flex transitional living assistants are eligible to vote provided they were employed during the payroll period ending 9/1/13, and worked an average of four (4) hours or more per week during the 13 weeks immediately preceding the eligibility date for election.
