Legal Advisor (closing date: 4 November 2014) Terms of Reference for LEGAL ADVISOR for SEPI Position: Legal Adviser Place: Secretary of State for the Promotion of Equality (SEPI) Closing Date for applications: 4 November 2014 Contract period: 4 months (with the strong possibility of extension) Expected Start date: January 2015 Background The Secretary of State for the Promotion of Equality (SEPI) was established by Decree Law No. 7/2007, of 5 September which instituted the new organizational structure of the V Constitutional Government. The organic Law of SEPI no. 16/2008 was approved by the Council of Ministers on 4th June 2008 and stated that SEPI is the Government’s main body responsible for the design, execution, coordination and assessment of the policy as defined by the Council of Ministries, for the areas of promotion and defense of gender equality. SEPI seeks a Legal Adviser to support SEPI to mainstream gender in legislation and advocate for implementation of the law in a manner that promotes gender equality. The Legal Adviser will develop legal opinions and draft legal perspectives to support SEPI’s advocacy on relevant issues specially in observing the principles of the Convention of Elimination of All Forms of Discrimination Against Women (CEDAW). Where appropriate, the Legal Adviser will participate in legal drafting working groups and generate research, comments and background on legislation to be socialized to stake holders such as Gender Focal Points and members of Parliament to promote SEPI’s goal of ensuring legislation reflects gender equality principles. The Legal Adviser will provide on-going mentorship to build capacity of staff to review and advocate for gender equality in legislation and legal policy related to gender justice. The Legal Adviser will work closely with the State Secretary, the staff at SEPI and other Gender Advisers at SEPI in providing guidance and support to the implementation of SEPI’s activities based on mandates and strategic plans. In addition, the Legal Adviser will support SEPI in the implementation of the Law Against Domestic Violence through socialization and coordination of government implementation of National Plan of Action and general support to SEPI and government partners. Duties and Responsibilities of the Legal Adviser at SEPI Perform a gender legal analysis of documents; - Draft and analyze legislation proposals, national and international agreements from a gender perspective or in compliance with CEDAW; Provide advice to the Secretary of State for Promotion of Equality and SEPI Directors on legislative priorities and focus areas; Work with other international advisers to support gender mainstreaming initiatives, with a focus on implementation and socialization activities related to the Law against Domestic Violence to ensure compliance with CEDAW and other legislation; Support SEPI staff to acquire the knowledge and skills to review legislation from a gender equality perspective through development of guidelines, on-the-job training and skills transfer; Support SEPI staff to attend relevant Working Groups such as the National Action Plan for Gender Based Violence, Trafficking, Referral Network and other legal oriented workshops, consultations and meetings as they arise; Prepare required reports and submit as per deadlines or as required; and · Perform other duties as assigned. Qualifications Master’s or equivalent degree in Law, preferably with University Studies in Gender, Human Rights, Development and/or other relevant for the assignment 7-10 years of experience in the legal field, particularly in the areas of human rights, gender equality, and women’s empowerment. Demonstrated working experience in evaluating compliance of national legislation with international legal norms and frame-works, particularly in the area of human rights; Working experience in developing countries and/or in post-conflict environments, preferably in Timor-Leste; Demonstrated working experience in capacity-building and advocacy; Working knowledge of procedure in civil law systems. Working knowledge of English and ability to read and understand Portuguese are a requirement. Tetun is desirable. Openness to learn local languages upon recruitment.
