Less than 72hrs after I disclosed that there would be no election as far as legal process is concerned, the Supreme Court of Liberia, acting on a fourteen counts petition filed by three groups: The Concerned Group of Eminent Citizens, the Movement For Progressive Change (MPC) and Leaders of Political Parties and Civil Society Organizations (CGEC) by and their Spokespersons Blamoh Nelson and J. Emmanuel Z. Bowier, John Ballon, Milton and Nathaniel Barnes before Justice in Chambers, Philip A. Z. Banks praying the praying high court for the issuance of the Alternative Writ of Prohibition against the within named Respondent _Government of Liberia represented by the Ministry of Justice and the National Elections Commission through its Chairman Jerome Korkoya, for the holding of Special Senatorial Elections amid the unending Ebola outbreak. The High Court has issued a Writ of Prohibition. The groups are represented by Cllr. Sayma Syrenius Cephus. The petitioners pray that Grant Petitioners Petition and issue an Alternative Writ of Prohibition against the 1st and 2nd Respondents to enjoin, stop and Stay any further actions or proceedings on their part regarding the holding of senatorial elections throughout the length and breadth of this Republic; and 2. Issue the Peremptory Writ of Prohibition after the conduct of a conference with the parties, and thereafter impose other imperative ex parte remedial actions on 1st RESPONDENT and 2nd RESPONDENT to revert to Article 1 of the 1986 Constitution to determine the date of the Special Senatorial Election in such a manner as will not disturb the status and standing of the Government, but will instead preserve the constitutional legitimacy of the Government. In response to petitioners` argument, Cllr. Korkoya said the move by the three groups is a scare tactic because according to him, they dont see their chances of winning a seat at the polls. Cllr. Korkoya was immediately warned by Justice Banks to desist from making such statements as it would undermine the independence of the elections commission. Final argument on the matter is scheduled for next week, December 2, 2014 when the NEC shall file a RETURNS.
