St. Croix you are playing right into the hands of the most corrupted governor in Virgin Islands history as he makes his last ditch efforts to stick his lopsided ARB deal right down your throats just like he did with his corrupted Diageo “Pirates” deal. Yes St. Croix, he also stuck it to you during his extremely corrupted viNGN deal when he crowned himself “King of viNGN” and never built you “his” viNGN Headquarters on St. Croix. St. Croix here is what Governor John P. deJongh, Jr. and ARB is hoping you would not take time to read as you continue to drunken yourselves during your annual Christmas Holiday festivities: We know that on Wednesday October 29, 2014, Governor John P. deJongh Jr. and Robert Moore, Chief Executive Officer (CEO) of Atlantic Basin Refining V.I. (ARB) signed a proposed Hovensa Refinery operating agreement that will now go back before the 30th Legislature for ratification this coming Friday December 19, 2014. We also know that Robert Moore made Canadian history through his involvement in that Country’s Bank of Montreal biggest trading loss which was estimated to be around $618 million dollars. Governor John P. deJongh, Jr. signed a proposed operating agreement with this so called CEO, on behalf of the people of the Virgin Islands with emphasis on CRUCIANS, and did not come clean on this so called CEO unsavory background. We know ARB has absolutely no prior history as a company in safely operating any oil refinery. This so called company has no “company history” because it was just recently formed for the sole purpose of getting its hands on the Hovensa Refinery by whatever means necessary to include hiding its CEO unsavory background during its appearance before the 30th Legislature. The proposed ABR operating agreement alleges payments to the Virgin Islands government totaling more than $1.6 billion over the life of the agreement and alleges employment of hundreds of Virgin Islanders, according to the notorious deJongh Administration. The proposed agreement also has a 22-year term and two 10-year renewal options, according to senators. This proposed Virgin Islands government agreement with ARB is the most important agreement surrounding the Hovensa Refinery since Hess first opened the refinery on St. Croix. It is a known fact that Hovensa Refinery is the location of worst IN-LAND/UNDERGROUND oil leak in United States Environmental Protection Agency history yet the notorious deJongh Administration has signed an operating agreement with a company that has absolutely “no” company history at safely operating “any” refinery. The amount of petroleum being cleaned up from the groundwater at the St. Croix Hovensa Refinery is nearly four times that of one of the worst oil spill in U.S. history -- the Exxon Valdez spill on the Alaskan coast in 1989. (Source: TheDominicanNet) Leaks from Hovensa’s oil processing and storage have resulted in plumes of oil floating on top of the groundwater underlying the facility. Cleanup at this site is being addressed by HOVENSA under EPA oversight, according to the requirements of the facility’s 1999 Resource Conservation and Recovery Act (RCRA) Operating Permit. Monitoring wells along the northern perimeter of the facility are sampled semi-annually to detect if oil or other hazardous materials are present. In addition, an ongoing program of leak detection and repair is designed to prevent or minimize further releases. Off-site migration is prevented through a program of maintaining hydraulic control by means of active ground water pumping. (Source: US EPA Region 2) In May 2012, WESTON SOLUTIONS, INC. Edison, NJ, prepared an Expanded Site Inspection and Removal Assessment Report of the St. Croix Alumina (Renaissance Park) Site (Document Control No. 1455-2A-ATIW) for the United States Environmental Protection Agency (EPA) and concluded: There have been various documented petroleum releases at the Site throughout the years and a resultant plume of separate-phase petroleum hydrocarbons exists on the water table in the eastern portion of the Site, north of Alucroix Channel.....Leaks from tanks and associated piping at the Site and the adjacent HOVENSA FACILITY created the plume, which is being remediated under an Administrative Consent Order with EPA. There is also crucial information contained in the following report by Duff & Phelps Securities regarding any potential future use or sale of the Hovensa Refinery: Duff &Phelps Securities Highest and Best Use of the HOVENSA Refinery Results and Findings Related to the Services Outlined in RFP-0023-2012(P) Prepared by: Duff & Phelps, LLC Duff & Phelps Securities, LLC August 3, 2012 Avoidance of Environmental Related Costs Imposed by the EPA: “In 2011, HOVENSA entered into the Consent Decree with EPA and the GVI which requires the installation of equipment and the implementation of additional operating procedures with an estimated total cost of $700.” Assumptions & Limiting Conditions: “The QUALITY of business management can have a direct effect on the viability and value of the business. The financial projections contained in the presentation assume both responsible ownership and COMPETENT MANAGEMENT unless noted otherwise. ANY VARIANCE from this assumption could have a significant impact on the assessment(s).” “In the assignment, the existence of potentially hazardous material(s) (i) used in the construction, maintenance or servicing of the building(s) and machinery and equipment of the business, such as the presence of urea-formaldehyde foam insulation, asbestos, lead paint, toxic waste, underground tanks, radon and/or any other prohibited material or chemical which may or may not be present on or in the subject real and/or tangible personal property or (ii) in existence of which the business may be held accountable, was, unless specifically indicated in the presentation, not disclosed to us during the course of this engagement. We, however, are not qualified to detect such substances. The existence of these potentially hazardous materials could have a SIGNIFICANT EFFECT on the value of the business. The client is urged to retain an expert in this field, if desired.” “Any decision to purchase or sell any interest in the business shall be the GVI‘s sole responsibility, as well as the structure to be used and the price to be accepted. An actual transaction involving the subject business might be concluded at a higher value or at a lower value, depending upon the circumstances of the transaction and the business, and the knowledge and MOTIVATIONS of the buyers and sellers at that time.” Senator Kenneth Gittens previously warned about Governor John P. deJongh, Jr. and Hovensa’s strong arm and “spoil child” tactics in the video at link below: Senator Gittens exhaustively warned his colleagues not to approve the Hovensa Fourth Amendment Agreement and to hold Hovensa responsible for massive environmental violations against the people of the Virgin Islands. Yet eight Virgin Islands senators (Senators: Judi Buckley, Donald Cole, Clifford Graham, Alicia Chucky Hansen, Shawn-Michael Malone, Nereida Nellie Rivera-OReilly, Clarence Payne and Samuel Sanes) disregarded his warnings and approved the Fourth Amendment Agreement with Hovensa in November 2013. Both of these entities have proven themselves to be a “clear and present danger” to the people of the Virgin Islands when it comes to issues surrounding Hovensa. It seems as though that not even prayer can get John P. deJongh, Jr. to “Do the Right Thing”.
