Most states have laws which require a person with epilepsy to have a specified time seizure free (medicated or not) before they can get a drivers’ license. New York State requires new applicants to affirm that they do not have a condition which alters their consciousness and requires people to self-report any such instances to the DMV. Six states (California, Delaware, Nevada, New Jersey, Oregon and Pennsylvania) require physicians to report patients who have seizures and other potentially consciousness altering conditions (diabetes, vaso-vagal syncope) to the department of motor vehicles. These mandatory reporting laws have been discontinued in most states because they may discourage people from seeking treatment for serious medical conditions including epilepsy.
