Daniel Zazulka Choking someone to death would mean you took your last breathe while some had their arms, hands or something else around the esophagus not allowing any air exchange. He wasnt choked to death, he had asthma, was over weight. Its a shame that after 33 prior arrest, he didnt know the procedures. It is also a shame that he passed away over such nonsense. Follow the laws and there shouldnt be any issues. In many other places, these types of physical strongholds are banned because they can cause injury or death, not only to people with prior conditions, but also to people who may just have a weak physique or so. And there is such a thing as wrongfull arrest; police tend to do profiling and arrest people with no real evidence to back their assumed suspicion. They are not supposed to hurt anyone, if they are guilty of said crime or not. Now you may find that a criminal is not human; but do you honestly think that killing a person makes society, you or I as members of such, any bit better than someone performing an act of crime? If this had been a civilien doing the same thing to another civilien they would be punishable to at least second degree murder, do to a prior existing diagnosis, they knew nothing about. Brianne Mondello Sorry but they did kill him. He said 8 times he couldnt breathe. They should have called the ambulance the moment he said he couldnt breathe the first time. They used excessive force. He was talking to them, not resisting. Even if he was yelling at them, he didnt touch them, they didnt have to grab and throw him down the way they did. There are good cops but there are also corrupt cops and power hungry cops and cops with anger management issues. These police officers were negligent. And their negligence caused this mans death over a stupid crime of selling looses. Just because a cops job is dangerous doesnt mean they have the right to beat on civilians. And just like soldiers, cops know the dangers they are signing up for. And you just pray they get to come home safely. This is a wrongful death claim against the NYPD and the officers individually. When you get arrested, its not supposed to tickle. Its supposed to be uncomfortable. Holding them down is procedure so you dont get your face spit on. Immediately when he pulled away, he is resisting. You dont know what hes carrying or what he is capable of. They were not negligent, they were doing their jobs.
