On March 24, 2014, the trial lawyers and Consumer Watchdog submitted signatures to qualify an initiative for the November ballot which requires drug testing for physicians and mandatory checking of CURES, and also raises the cap for non economic damages to about $1.1 Million in medical negligence cases. That cap has been $250,000 since 1975, when the Medical Injury Compensation Reform Act was adopted which separated cases against medical providers and severely limited the recovery by someone who was seriously injured or died as ar result of negligence of that medical providers. That $250,000 applied no matter how egregious the conduct or serious the injury. That is all a victim could recovery for pain and suffering even if a rendered helpless for life, or in a death case of a a loved one by the heirs. Draconian. This is long needed for consumers of health care services. The doctors and hospitals will be fighting this hard. It is time for patients and their families of have justice. The initiative needs to pass.
