On Monday of this last week, Attorney Valarie Potell of The McShane Firm delivered a big smile for her client and his family. It was his 11th DUS-DUI, along with five other summary traffic offenses. He told her from the beginning that he was not driving and that it was an acquaintance to whom he had sold his truck that day who was actually driving. The trooper had been called to the scene of an accident and neither of them were there because they left the truck. Attorney Potell met with the client in office to go over his sales slip and bank statement, spoke to him on the phone several times, and subpoenaed a witness who saw him leaving that night in the passenger seat. When they went to the MDJ initially, Attorney Potell explained the situation to the trooper. He said he would look into it and they continued the case because the witness was not there either. When they returned on Monday to the MDJs office, the trooper had not been able to confirm the acquaintances information. However, after talking to Attorney Potell and hearing what the witness had to say, the trooper withdrew all of the charges. Three cheers for the trooper for seeking justice and for Attorney Potell doing a fine job!
