Please find my op-ed when I validate the US military can take over using the Declaration of Independence. It begins with the how the US was founded first by the declaration by Washington founded our military and then West Point 7 years before there was a constitution. The declaration was written while the colonies were still under common law and is a common law document. The declaration nor the constitution were designed nor did they state that the declaration was to get rid of the Common law of England. So, as our law books state that the common law of england stands, that whenever there is no law the common law of england takes precident. Thus, the declaration as an established common law and no other document replacement it is the means to get rid of tyranny. We now have tyranny and is easy to prove. Thus as I note, the military only needs to go to their own court, established by Washington, write the list of particulars proving tyranny, and simply drive over to the White house and congress and arrest those that created the tyranny.
