Please help me understand these scanarios: 1. you write an offer on a property. The offer is verbally presented and both parties come to an agreement on price but the listing Realtor claims the seller cannot be reached till in the evening the next day. you wait. The next day you get told by the listing Realtor that you are now in a multiple offers situation. Your client comes up $11000 over the previously mutually agreed on price. In total, your client has agreed to pay $1000 over list price. The next business day, you speak to the client mortgage broker and learned that the client is $16000 over their limit but he will try and see what can be done. You immediately informed the other Realtor that deal is dead because of financing issue and that they should take advantage of the second offer. You immediately get incessant phone calls from the listing agent negotiating the price way below the 325k that was initially verbally agreed to. (property listed at 335k) All of a sudden, the listing Realtor tells you that the seller is prepared to accept $320k!! By this time your client is now feeling suspicious of you. Why the sudden offer that they should now pay 320k instead of 336k. Suspecting that there never was a multiple offer, you enquired and was told by the competing Realtor that there was a hint of another offer but there never was another offer. Again, you recieve 6 panicky phone calls from the listing Realtor in short order. Instead of replying, you sent an email informing the listing Realtor that the deal is dead. All this happed in 72 hours. And you are branded un-professional for tying up the property! Scenario 2. You are asked by the listing Realtor to have your clients sign an amendment accepting the fact that the deck is non compliant; and that the gazebo and dog run will be removed a month after possession when the snow melts. instead, you asked your cleint to speak to their lawyer for advise!! Again you are branded as un-professional. Really??? Tomorrow is a new day!!!
