Posted by Ron Weber: After thinking about this decision I offer the following: The City is under tremendous pressure from the citizens to deny these applications. They are also under pressure from developers that have most likely tried to work with them and also from a legal standpoint.......the City does not want a lawsuit over this. I personally felt the applications would be approved with conditions by the Planning Commission and then ultimately denied by the Council. For a variety of reasons I didnt expect this decision. I believed, and still do, that there are City representatives that are in favor of this development (Lynwood) and never expected the public to turn out in force the way we have. But, the City needs validated reasons to deny the request since the developer has created an illusion (with the help of Megan Will) that this actually could meet the requirements of the Developmental Plan. The facts are very clear. The application simply does not conform to the Development Plan. Its that easy. Plus, the requested development is so convoluted that there is no zoning category for it to fit into. Everything else we bring up; crime, traffic, schools, city services, are all secondary to the fact that the development must conform to the Plan; and it doesnt (Not that these other issues are not important). The Planning Commission tried hard to explain this while justifying their decision. In my opinion........the many references to amend the Plan and how to amend the Plan signify one or two facts. 1) They are trying to provide a Roadmap for Lynwood to follow to eventually get this approved or 2) They have stated these things to gracefully bow out and avoid a lawsuit while appearing to placate Lynwood. Either way, it is important to keep this process alive. The City Council can still approve this mess despite the recommendation from Planning. In addition, remember that this is One of Two applications. The Brand application cannot be denied due to not having a classification for it. There is a classification for straight up apartments. Brand may not be this easy. But the facts remain........neither of these applications conform with the Developmental Plan for the City. The Plan must be amended before the applications can be realistically entertained. We need to Keep the Faith and keep up the involvement!
