Section 511 of Title 38 USC The Secretary shall decide all questions of law and fact necessary to a decision by the Secretary under a law that affects the provision of benefits by the Secretary to veterans or the dependents or survivors of veterans. The decision of the Secretary as to any such question shall be final and conclusive and may not be reviewed by any other official or by any court, whether by an action in the nature of mandamus or otherwise. Our Service-Disabled Veterans need true Article III judicial review of their claims before the Department of Veterans Affairs. Under the current Adjudications system Our Veterans are forced to wait 20 to 40 years before they are able to get their just compensation for their Service-Connected injuries and disabilities. That is not just nor is it right or moral. Once I take office I will declare Section 511 unconstitutional and open up the Federal Courts to our Veterans so they will get the just compensation they deserve and without being forced to wait longer than 6 months to a year. That is because once our Veterans are able to get a lawyer to file their claims they will firs look to see if there are any similar cases and go from there. One court case could settle over a thousand other similar cases thus cutting down on the backlog of cases and the wait most Veterans are forced to suffer. Only YOU can make this happen.
