Separated couple in court over ‘loan’ 04 SEPTEMBER 2014 BY OBARE ERIC SENATOR hivisasa A Nakuru-based businesswoman embroiled in a property tussle with her estranged husband has told a Nakuru court that her husband owes her Sh700,000 he borrowed. Jedida Apondi told principal magistrate James Mwaniki that Nicholas Juma has been snubbing her whenever she demands back the money which she claims to have loaned him on May 5 2009. Apondi claimed that efforts to get the money from her husband have been fruitless. She told the court that the every time she has been demanding the money, the husband has been claiming that it was part of their matrimonial property acquired during their marriage. “l have made several attempts including an out of court settlement to have the money back but my efforts have been futile,” she told the court. According to an agreement dated May 10 2012 she presented in court, the husband was supposed to clear the debt one month after receiving the cash. Apondi said the reluctance of her former lover to refund the.money has paralysed her business activities and urged the magistrate to compel him to pay back the money. “I need the money to carry out my business errands. Delayed payment of the money might lead to closure of my businesses,” she noted. In the case, Apondi alleges that her husband committed crime of bigamy by getting married to another woman before they differed and separated. The complainant moved to court in 2012 seeking orders to compel the husband to clear the debt. She further wants her ex husband to pay for the cost of the two-year-old suit. Judgement was fixed for October 29.
