Should criminal lawyers have to refund money to clients in certain circumstances? Weve noticed a significant increase in clients being told that their defence lawyer is unavailable for their Local Court Defended Hearing (the most important court date at the end) and then calling us just beforehand to represent them.. We are, of course, more that happy to help and have the experience and resources to do so. But its concerning that these clients had already paid thousands of dollars before being ditched. Its equally concerning that, in some cases, clients had been inaccurately advised and/or had very little actual work done on their cases - with charge negotiations sometimes not occurring at all!! What do you think - Should criminal lawyers be required to pay back money that clients have paid through the course of proceedings if they pull out just before the hearing date?
