TALK TUESDAY | FAMILY LAW CONNECTION | ATTORNEY MIKE NAVARRO | NAVIGATING DIVORCE: PAYING ATTORNEY FEES | Once you have decided to hire an attorney you will be expected to pay a retainer fee. The initial retainer will often depend upon a number of factors, including 1) the experience of the attorney, 2) the size of the firm selected, 3) the claims for relief involved, 4) whether any discovery will need to be done, 5) the anticipated time for trial and 6) the jurisdiction you are in. Among the things I mentioned, I would focus on the number of claims your case could include. A simple uncontested divorce in North Carolina costs between $300-$500. Once you add in claims for child custody, child support, post separation support and/or alimony and equitable distribution, then you can easily expect a retainer beginning at $5,000. If litigation will be required to resolve all those claims, then attorney fees may well exceed $10,000. For some of those claims, you may be entitled to attorney fees, however that will depend upon the applicable statutes in your jurisdiction.
