The Customs and Border Protection people in Washington have now clarified their statement about prosecuting medical marijuana users in New Mexico at Federal checkpoints. While they say agents have discretion on this, the continued policy is to prosecute people, even if they have a prescription. So, while the FDIC (a federal agency) now allows for banks to handle recreational marijuana money and the DEA (another federal agency) isnt raiding legal marijuana shops in Colorado as they sell to the general public, a cancer patient with a prescription here in New Mexico can still be prosecuted and jailed if they are stopped at a Border Patrol checkpoint. This is inconsistent, and insanely stupid.
