The EAT has awarded a sacked supervisor €50,000 for unfair dismissal. The worker was dismissed for gross misconduct following an investigation sparked by a gone-off chicken wrap. The MD of Gate Gourmet told the EAT hearing that it takes such incidents very seriously and the claimant was dismissed on the grounds that he did not take responsibility for his job as store supervisor. However the EAT found that it was unfair and unreasonable to conclude that the claimant was solely and exclusively responsible for the failure, and the sanction of dismissal for gross misconduct was disproportionate in all the circumstances.
