The Georgia Court Of Appeals recently ruled in favor of a client charged with aggravated child molestation. Despite the fact that the alleged offense took place over ten years ago, the DA indicted my client. I filed a motion (General Demurrer, Plea In Bar And Motion For Discharge And Acquittal) on the ground that the statute of limitations (time in which to initiate a criminal prosecution) had expired and the trial court granted my motion. The prosecutor appealed this decision and the appellate court affirmed the trial courts dismissal of the case. This is the second time that the Georgia Court Of Appeals has granted me a dismissal of a case based upon a Plea In Bar And Motion For Discharge And Acquittal.
