The state Fair Political Practices Commission now has let it be known that it is levying a $40,000 fine against a SF property management company for laundering money to Ed Lee’s 2011 mayoral campaign committee. Earlier SF DA George Gascon announced he was filing now charges because he could not find sufficient evidence, despite sworn affidavits from employees who said they were repaid for their contributions. This is a clear example of why the SF Civil Grand jury recommended in June that SF enforcement cases be contracted to the FPPC because of conflicts in SF enforcement. Gascon had endorsed Lee, and vice versa, in the same election. In the Matter of Archway Property Services, LLC, and Andrew Hawkins Cohen; FPPC No. 11/1056 (Default Decision). Staff: Commission Counsel Adam Silver, and Special Investigator Beatrice Moore. Respondent, Archway Property Services, LLC (“Respondent Archway”), is a San Francisco-based apartment maintenance and property management firm. At all times relevant to this matter, Respondent, Andrew Hawkins Cohen, served as the Managing Director for Respondent Archway. In this matter, prior to the 2011 San Francisco Mayoral Election, Respondent Cohen directed Respondent Archway’s President and six of its employees and contractors to make eight separate $500 contributions, under their individual names, to 2011 San Francisco Mayoral Candidates Phil Ting and Ed Lee. Respondent Cohen later reimbursed all seven individuals for their contributions to Candidates Ting and Lee using Respondent Archway funds, in violation of Government Code Sections 84301 and 84300, subdivision (c) (8 counts). Total Proposed Penalty: $40,000. Archway - Default Decision and Order And here is Gascon’s record: sfgate/bayarea/article/No-charges-for-firm-in-Ed-Lee-donations-3846424.php District Attorney George Gascón will not file criminal charges in the case of a property management firm accused of laundering thousands of dollars in contributions to Mayor Ed Lees election campaign last fall, a spokeswoman said Thursday. There was insufficient evidence to support criminal charges, said Gascón spokeswoman Stephanie Ong Stillman. She declined to go into specifics on the decision.
