There have been several questions asked in regards to the new cell phone ordinance. Here is a condensed version of the ordinance, however; please feel free to contact us if you still have questions. There will be a grace period in which we will be issuing warnings in an effort to help educate the public on this new law. 4.02.19 Use of hand-held mobile telephones and mobile electronic devices prohibited. (1) Prohibition. No person shall operate a motor vehicle on any street or highway within the city limits of the City of Rhinelander while using a hand-held mobile telephone or mobile electronic device. (2) Definitions. The following definitions shall apply in their interpretation and enforcement of this action: (a) “Authorized emergency vehicle” shall have the same meaning as in Wis. Stat. §340.01(3). (b) “Mobile electronic device” means any hand-held or other portable electronic equipment capable of providing data communication between two or more persons, including a text messaging device, a paging device, a personal digital assistant, a laptop computer, equipment capable of playing a video game or digital video disk, equipment which provides navigation assistance to the operator of a motor vehicle which is not installed or integrated into the electrical system of a motor vehicle, or equipment on which digital photographs are taken or transmitted, or similar device or any combination thereof. (c) Mobile telephone” includes cellular, analog, wireless or digital telephone capable of sending or receiving telephone communications with an access line for service. (d) “Operate” shall have the same meaning as in Wis. Stat. § 343.05(1)(b). (e) “Use” or “Using” shall mean to dial, answer, talk, listen, send or read a text message or other manipulate the controls of a mobile telephone or other mobile electronic device. (3) Exceptions. (a) The provisions of this section shall not apply to law enforcement personnel or operators of emergency vehicles when on duty and acting in their official capacities. (b) The use of emergency 911 phone numbers shall not be prohibited for any person operating a motor vehicle in the City of Rhinelander.
