Understanding History why we could have failed in selecting right people to head the Heath care. By Leonard Wamalwa 2014-04-30 from West Fm Trans Nzoia County assembly adopts 11 names of chief officers Trans Nzoia County: The Trans Nzoia county assembly on Tuesday evening voted and adopted 11 names of people nominated to the posts of chief officers despite the appointment committee recommending that the names be rejected. The members voted in favor of the names after a grueling debate of over two hours in which the house was divided into two with one side supporting the adoption as the other side especially members of the appointment committee supporting their decision to have the list rejected and sent back to governor Patrick Khaemba for amendments. Speaker David Sifuna had a rough time controlling the members during the debate as they bitterly exchanged words in support or defense of their sides of preference in the matter. The assembly after voting for the names of the nominees later voted for the nominee for the county executive committee member for agriculture Dr Wycliffe Wabwile Kiiya whose name had also been forwarded to the assembly by the governor alongside those of the chief officers. Contentious issues raised by committee Out of the eleven nominees, four nominees were pinpointed out by the committee to have serious issues that could not allow their names to be adopted by the house members. The entire list was also said to have not met the requirements of gender balance in which only three nominees were female out of eleven and was also said to have failed to adhere to the ethnic balance as required by the constitution. One nominee who had been appointed to be chief officer in the ministry of health services Dr Mourice Wakwabubi had a memorandum filed by a group of nurses brought to the county assembly detailing as to why the doctor was not fit to be the chief officer in the docket. The committee revealed that Dr Wakwabubi’s nomination had been opposed by 115 nurses from Kitale district hospital whereby he had served as a medical superintendent until the end of the year 2011 when he was transferred accused of having sued the nurses whom he had indicated that the nurses had damaged his name and reputation. The case number 298 of 2012 is still pending at the Kitale court and hence the nurses felt that if at all the officer has not withdrawn the case in pursuant of his new post then chances are that he might not be impartial in handling the nurses and other officers at the hospital who will be directly under him as a chief officer “The committee posed the question whether the nominee for health is the proper and fit person to hold the office of such circumstances such as whether if appointed he will act impartially while presiding over the people he feels have wronged him and is demanding general, exemplary and aggravated damages, and cost of the suit among other issues related to the case,” read the speaker as he tabled the report in the assembly. The committee therefore recommended that the nominee for the health docket as chief officer had failed the test and thus his name shouldn’t be approved. Others nominees with issues included Fred Wanyama Simiyu who was said to have failed to meet the professional requirements according to the committee who said that he did not belong to any professional body. Professor Ben Wanjala who had been nominated for the seat of chief officer in ministry of agriculture and Mary Wamboi Nzomo who had been nominated for the position of chief officer for livestock, fisheries and cooperative management were said not fit to hold the positions bearing in mind that the dockets under which they had been nominated to serve had not been initially advertised for according to the findings of the appointments committee. The committee also reported that the public service board that advertised the positions of the chief officers had pointed out that the jobs were to be on contract basis but had not made clear the period of the contract and therefore the list had to be send back for such issues to be cleared first and thus the speaker read that the whole list violates the constitution. “In conclusion therefore the committee finds that the entire list of nominees violates the constitution and is a constitutional null and void, the health nominee Dr Mourice Wakwabubi is unfit to be approved, the finance nominee Fred Wanyama Simiyu is unfit to be approved, Professor Ben Wanjala for agriculture cannot be approved for position which he has been nominated since the same was not advertised and Mary Wamboi Nzomo the livestock, fisheries and cooperative management nominee cannot be approved as the post for which she was vetted for was not advertised in such a manner,” said the speaker as he read the report. “This list is long overdue and should be adopted as it is because our county is lagging behind in many issues due to delay in having such important officers in office and therefore we support this list and the governor so that the county can achieve its development agenda,” said Nangekhe. The supporters further dismissed the question of ethnic balance and integrity claiming that it was not possible for the county government to accord each community a slot in the county government citing the national government that did not meet such requirements and also pointed out president Uhuru Kenyatta and his deputy who were allowed to vie and eventually won the positions despite having cases at the international criminal court –ICC at The Hague in Netherlands. The nominees included Koros Kipserem for water, environment and natural resources, John Kwemoi Meng’wa for education, information and communication technology, Lineka Nafula Bwire for lands, housing and urban development, Dr Mourice N Wakwabubi for health services as Fred Wanyama Simiyu was nominated for the finance docket as chief officer. Others were Kiprop Shadrack Kimutai for gender, youth, culture and sports, Eng. Wasike Wanjala for transport and infrastructure, Lucy Doyi Kihamba public service management, Fred Masibo Simiyu-economic, planning, commerce and industry, Professor Ben Wanjala-agriculture and Mary Wamboi Nzomo for livestock, fisheries and cooperative management.
