PCSUPT PRUDENCIO TOM TALAPIAN BAÑAS Regionl Director PRO 7, REGION 7 CEBU CITY SIR: Last Friday, November 7, 2014, my brother was apprehended by a full police force, heavily armed, along the highway near Maslog Elementary School, Sibulan, Negros Oriental, at around 12:00 o’clock noon. Below is the story about the actual abduction told by my brother’s wife who was with him during the incident: “We were seated in the front seats of Ceres Bus Liner. When the bus stopped, to our surprise, the bus conductor motioned us -only the two of us- to get off. The moment we stepped down, we were right away surrounded by a group of heavily armed men in uniform. My feeling was that they were afraid that we would get away, so I cried, ‘What have we done?’ ‘What have we done?’ We were brought to Agan-an Detention Center and there, we were shown some pictures of the two of us attending a wedding. The apprehending officer told us that my husband was tagged as NPA leader in Tanjay City and he has been under surveillance since August, 2014. My brother, Constantino Navarro Saga is a retired District Supervisor of DEP Ed., Tanjay City. He is the nephew of the late Atty. Cipriano Saga, former Secretary of Education, and he has been a member of the Boards of Directors in this and that organization in Tanjay - now, tagged as NPA leader? On that fateful day, November 7, 2014, he and his wife had been from Dumaguete for a medical checkup. Tantin Saga, as he is popular called, is 70 years old, a diabetic and has difficulty walking and talking after he suffered from Bell’s palsy a year ago. An NPA LEADER? SIR, I am writing on behalf of my brother and his family who have been shamed and traumatized as a result of this incident. Imagine them arrested in broad daylight surrounded by heavily armed men before a truckload of passengers. Please find time to answer the following questions, the answers of which may help us in our decision to take legal actions: 1. When an informant gives the Police a name as “suspect”, complete with pictures, has the police the right to receive hook line and sinker the information that has not been verified? 2. When my brother and his wife were under police custody in Agan-an, they were asked to name a Tanjayanon who can identify them and vouch for their release- was that the correct procedure - to apprehend first, then ask for names of people to identify the “Suspect”? 3. They said my brother has been under surveillance since August 2014. That means they know my brother’s name. Why did they not make inquiries themselves? Did they find a probable cause? Why did they not inquire, ask any knowledgable Tanjayanon about him, like the City Mayor, the chief of police, to name some. Because, this is what they learned from schools/books to apprehend first then inquire later? 4. Now, my brother has been cleared of the tag as an NPA leader, thanks to Juanito Condes Sr., former Tanjay City Chief of Police, and now Tanjay City Councilor, who vouched for my brother’s integrity. • What is the least that your Office can do to rectify this blatant error? 5. Finally, will you please tell us a valid reason why we should ignore this incident and not take legal action against people concerned? Your immediate reply to this letter of inquiry and complaint will be highly appreciated.
