We have been receiving multiple phone calls and emails regarding the time it takes to process the K1 fiancé/e visas and the CR1/IR1 spousal visas. When we give them the current timing for the particular situation, oftentimes we are told that another attorney quoted a much longer time estimate. The reason for the difference between our time estimate and the time estimate given by others is that the other attorneys are solely basing their estimates on the USCIS monthly reports at USCIS.gov. We do not use those reports for our timing estimates because they are seldom current. Instead, we prefer to estimate our processing times based the actual timing we receive for our current clients’ visa petitions. Currently, our K1 visa petitions being processed at the California Service Center are taking 45 days from receipt to approval and 128 days for those processing through the Vermont Service Center. The CR1/IR1 spousal visas are currently taking an average of 193 days at both service centers. In many cases our actual processing times are weeks to months faster than the times posted by the USCIS.
