Wendy Donigers book is under the general public license ibnlive.in/news/the-hindus-row-readers-ask-penguin-india-to-give-up-copyright/452136-40.html Above is the link of the legal notice sent by Alternative Law forum on behalf of the public (?) asking the Penguin to relinquish its copyrights in the Wendy Doniger’s book “The Hindus – An Alternative History”. The notice is superfluous and wrongly appropriating of the public’s right to publish the generic copies of the book. The suit no.360 of 2011 filed by the plaintiff was a class action, and the acceptance of agreement between the plaintiffs and the defendant/s by the court is reflective of a leave granted to the plaintiffs u/o 1 r 8(2) CPC and execution of all procedures thereof,and if not, the settlement is void. In any case, the notice sent by Alternative Law Forum is superfluous as either the promise made in a class action by the Penguin is a promise made to the public or else the settlement itself is void vide o 1 r 8(4) CPC. I have already published the generic copy of the book at ankur.x10.mx/wendy-donigers-hindus-alternative-history/ under an assumption that the settlement has been recorded in a class action and, if the case is otherwise, unless the Penguin moves the court by filing an appropriate suit for setting aside the settlement and the order passed thereof, it is obliged not to interfere in the right of the public to publish the generic copies of the book, the book is under the general public license now and anybody can publish it.
