aangezien er nogal wat mensen hebben met frans, volgt hierbij de engelse tekst bij het verhaal van norbert dentressangle - We will only give your first name, Jacques because you talk without the consent of your hierarchy. First, Jacques, explain us what we suspected. First I want to say that I m very satisfied that my colleagues constables who followed this file ended up to a very positive inquiry. So what’s happen? In 2007 Rumania is entering European Community. A transport company is bought by Norbert Dentressangle which is not illegal except that on the totality of 300 drivers 2/3 were sent to work in France. These people arrive by Minibus and in 2010 the border police from Modane control one minibus and notify to the good administration to check the working conditions of these drivers. - You mean that all these Rumanian drivers were brought here by bus for working in the Shenghen area that’s it? - Absolutely, these drivers came for a period from 4 to 5 weeks at the yard of La Motte-Servolex, beside Chambery where they took trucks stored in France but with Romanian licence plates and under cover of international transport in European Community were working only for Norbert Dentressangle in France. - Why is it illegal? It’s forbidden to work in France for these drivers? - It’s illegal because those people work directly for Norbert Dentressangle and only in France because there were absolutely no activity in Rumania from these drivers and as long as you are working in France for a French company you have to be registered at the URSSAF (for pension and social security but also tax), you have to respect the working regulation et that was not respected. - You told us that they were working 40 to 50 hours a week during 4 or 5 weeks and they were going back to their country. - I will give you precise numbers. We calculated that the salary per hour was 1.44€ netto et that the drivers were working until 56 hours a week knowing that the French working regulation allowed maximum 48hours a week. - You say 1.44€ for an hour but if you want to compare with a French driver, how much it is, you know? - It depends of the collective agreement but it’s around 10/11€ for an hour. - Oh yes that‘s very extremely competitive, with a system of bonus to go quicker? It’s something which is completely forbidden that they called kilometre bonus and these drivers became 10 cents per kilometre, so that means that with their Rumanian salary from 250€, this kilometre bonus and others bonus for expenses and food they want to make believe that the complete salary was about 1500/1700€. In reality it was not like that. But I also want to call your attention on the fact that they are breaking the French law, the French working conditions but also when you give a kilometre bonus you encourage these drivers not to respect the regulations, speed limit, driving time and so on… - Jacques, you’re an investigator at the border police, do you know if Norbert Dentressangle is an isolated case? - No it’s not an isolated case, I know that other people are doing it, there are others investigations in others departments, but I can also tell you that other companies are very serious, that you don’t have to put all the hauliers in the same basket. - It’s a complicated investigation? - Yes because it started in May 2010 until last autumn, autumn 2011. We had to find drivers who accept to testify and tell the truth about their working conditions. - They accepted easily? - It was not easy but we had to convince them that it was for their present and future interest. - What did they tell about their daily? - Their daily….. well you know Rumanians, even if they know they are utilized, in Rumania the average salary is from 250€ when you can find a job and if somebody is offering you by hidden bonus to have a salary from 1000€ you accept even if you know that it’s a low salary in the country you work. By these measures Norbert Dentressangle divided by 2 or 3 the cost of the payroll. - Jacques, why did you call us on the red phone of Europe 1? - Well for 2 reasons, to defend the French labour market, the European labour market and also to show that the inquiry started from us the border police. -Thank you Jacques
