district #6 resolution - 4/30/85 - approved by tribal council resolution no. 10a-86-CR -1/16/86 - whereas - it has come to our attention that a professional attorney known to us as al arendt has engaged in conduct that is prejudicial to the administration of justice to the members of the cheyenne river sioux tribe and whereas - it appears that mr. arendt applied undue pressure in our civil court and was successful in getting a stay of execution lifted in a child custody case that was on appeal to the cheyenne river sioux tribe court of appeals and whereas - mr. arendt has also taken cases regarding actions of the tribal council knowing full well that unless there is an explicit waiver of sovereign immunity by the tribal council there can be no cause of action - furthermore our court system is not empowered to overturn resolutions or ordinances enacted by the tribal council and whereas - mr. arendt is in direct violation of the south dakota code of professional responsibility - d.r. 2-109 acceptance of employment: (a) a lawyer shall not accept employment on behalf of a person if he knows or it is obvious that such a person wishes to: (1) bring a legal action - conduct a defense or assert a position in litigation or otherwise have steps taken from him merely for the purpose of harassing or maliciously injuring any person (2) present a claim or defense in litigation that is not warranted under existing law unless it can be supported by good faith argument for an extension - modification or reversal of existing law - now therefore be it resolved - that the tribal council take immediate action to suspend mr. arendt from practice before the Cheyenne rivers ioux tribal court
