#zimbabwe Dr Ndebele opts for out of court settlement ift.tt/1vO1VIN Auxilia Katongomara Chronicle Reporter PROMINENT Bulawayo doctor Nkonzo Ndebele and his customary wife have asked the court to grant them seven days to settle the dissolution of their marriage out of court.Grace Libetsi Ndlovu made the request through her lawyer Ndabezinhle Mazibuko on Monday. Ndlovu is the plaintiff in the matter as she applied for the dissolution of her marriage to the medical practitioner who two months ago filed for divorce against his first wife, Dr Samukeliso Ndebele (nee Vuma), at the Bulawayo High Court. Appearing before Bulawayo magistrate Victor Mpofu, Ndlovu, through her lawyer Mazibuko, asked the court to give them a week to settle their dispute. “We intend to settle the matter out of court and request for the mater to be postponed for a further week, failure of which the matter will be heard on trial,” said Mazibuko. Ndebele, through his lawyer Hlabezulu Malinga, consented to the application. Magistrate Mpofu postponed the matter to December 8. Ndlovu, in papers filed at Bulawayo Civil Court under case Number CC89/14, stated that in the event that the court grants her the dissolution, she should be awarded some household property, a residential stand in Douglasdale and five vehicles from the 10 owned by the city doctor. She said during her customary marriage to Dr Ndebele, they acquired 10 vehicles including three Mercedes Benz and a Jeep Cherokee. In her inventory of the couple’s property, Ndlovu listed all kitchen utensils including potato peelers, plates as well as a knobkerrie and 350 crates of empty bottle crates from the Railway Avenue business. Ndlovu claims her union with the prominent city doctor has irretrievably broken down. Ndebele said the marriage had broken down irretrievably on account of Ndlovu’s unreasonable behaviour. “The plaintiff diverted funds to pursue her own agendas unknown to the defendant. She disposed of the family business without the defendant’s knowledge,” said Ndebele. The medical practitioner further claimed that Ndlovu falsely accused him of domestic violence and reported him to the police. The couple has a six-year-old child and Dr Ndebele said it would be best for the minor child to be in her mother’s custody. However, he argued that he should be allowed access to the child during weekends, public holidays and two weeks every school holiday. Dr Ndebele consented to Ndlovu being awarded all the property she claimed except three motor vehicles – two Mercedes Benz vehicles and a Toyota. His divorce matter against his first wife is awaiting finalisation at the High Court. ift.tt/eA8V8J
